Promotion: saved search emails

Entry into the Promotion is deemed acceptance of these terms and conditions:

Eligibility

  1. To be eligible to enter, you must be:
    1. an individual who is 18 years or over; and
    2. a New Zealand resident who is eligible to purchase property (real estate) in New Zealand.
  2. You are not eligible to enter if you are:
    1. an employee, contractor or director of realestate.co.nz (Personnel).
    2. a member of a Personnel’s immediate family.
    3. an employee, contractor or director of any third-party service provider who is directly involved in this Promotion.
    4. a licenced real estate agent, or a licenced salesperson (licenced under the Real Estate Agents Act 2008).
  3. It is the responsibility of each person entering the Promotion (Entrant) to ensure they meet the eligibility criteria.

How to enter

  1. The Promotion starts on Thursday 26 October and runs through until midnight on Thursday 30 November 2023 (Promotion Period).
  2. To enter the Promotion and be in to win the Prize:
    1. During the Promotion Period you must do the following:
      1. Sign up to realestate.co.nz (if you already have an account, then you do not need to do this again).
      2. Log in to realestate.co.nz.
      3. Set up a saved search in the area/s you are wanting to purchase a property. Instructions on how to set up a saved search can be found here. 
      4. Go to realestate.co.nz/100k and complete the required details, answer the questions and agree to the terms and conditions.
    2. At midnight on 30 November 2023, you must have an active realestate.co.nz account and have a saved search.
  3. Only 1 entry per person. To avoid doubt, a person must not use different email addresses to enter more than once.
  4. There is no fee for entering the Promotion.

Prize and prize draw and notification

  1. There is one prize of $100,000 (NZD) (Prize) to be won to be used towards the purchase of a property (real estate) in New Zealand in the 12 months after the winning entry is drawn.
  2. The winner will be determined by a random draw, which will take place on 1 December 2023. The winner will be the first valid entry randomly drawn from all eligible entries (Winner).
  3. The Winner will be notified within 72 hours of the prize draw taking place.
  4. If the Winner does not make contact with realestate.co.nz by email (info@realestate.co.nz) or phone 0800 732 536 within 72 hours after realestate.co.nz has made reasonable attempts to make contact, the Winner forfeits the Prize and a new Winner will be determined on the same basis as the first Prize draw. This will continue until such time as a Winner is found.

Payment of Prize

  1. Before the Prize is paid the following must be met (“Payment Criteria”):
    1. realestate.co.nz must be satisfied (in its absolute discretion), having received supporting documentation from the Winner, that:
      1. the Winner is a purchaser (but does not have to be the only purchaser) of a property in New Zealand: and
      2. the Prize is being used for the purpose of purchasing the property.
    2. If required by realestate.co.nz, the Winner must provide details of their lawyer’s trust account for the Prize to be paid into.
    3. The property must be purchased in the 12 months after the winning entry is drawn.
  2. The Prize will be paid into (at realestate.co.nz’s discretion):
    1. the trust account of the lawyer acting for the Winner on the sale and purchase of the property; or
    2. A New Zealand bank account nominated by the Winner.
  3. If the Winner is unable to satisfy realestate.co.nz (in its absolute discretion) that the Payment Criteria is met, the Prize will be forfeited, and no compensation will be payable.
  4. The Prize cannot be changed, transferred, or assigned. In the event that the Prize or any part of the Prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter may, in its sole discretion, provide an alternative Prize.

Further terms if you are the Winner

  1. Entrants agree that if they are the Winner:
    1. They will provide realestate.co.nz with all information reasonably required by us to confirm that the Payment Criteria has been met.
    2. They will make themselves reasonably available for promotional/advertising purposes and being photographed for this purpose without any claim for compensation.
    3. Their name, town/city where they live, photos and likeness will be used by us for promotional and advertising purposes. This may include being published on our website, in newsletters, client communications, social sites, and other media platforms (such as television).
    4. To grant realestate.co.nz a perpetual, world-wide, royalty free and non-exclusive right and licence to reproduce, edit, publish distribute and otherwise use their entry details and photos for advertising, publicity, promotion and marketing purposes. The Winner will not be entitled to any fee for such use.

Privacy - what we do with your personal information

  1. When you enter this Promotion, realestate.co.nz collects personal information from you:
    1. name, email address, phone number, property journey information (‘where are you in your property journey?) (“Profile information”)
  2. The Profile information is collected for the purposes of this Promotion and for populating your account profile. You can update or amend your name, email address or property journey information at any time by logging into your account. You can also delete all this information by deleting your account. Your phone number will only be used to contact you if you are the winner and then deleted 14 days after the promotion closes and the winner has been successfully contacted.

Other terms and conditions

  1. By entering the Promotion, each Entrant:
    1. Acknowledge they have read our Privacy Policy.
    2. Consents to our website terms and conditions.
    3. Consents to realestate.co.nz sending saved search emails to the email address provided on registration with realestate.co.nz.
  2. We may verify the eligibility of entries and Entrants (including identity, age, residency status or other information). We reserve the right to disqualify any entry or refuse to award the Prize where false or misleading details have been given or where we believe (acting reasonably) an Entrant has been fraudulent or dishonest or is in breach of these terms and conditions.
  3. Failure by realestate.co.nz to enforce any rights will not constitute a waiver for those rights.
  4. Realestate.co.nz and any other agencies associated with this Promotion will not be responsible for any late, incomplete, lost or misdirected entries, including entries not received due to technical problems.
  5. Except for any liability that cannot be excluded by law, realestate.co.nz, its Personnel, and any agencies involved in this Promotion will not be liable for any loss, damage, liability, penalty, personal injury, fine, charge, expense, outgoing, tax, payment or costs of any kind (including legal and other professional costs) arising from the Promotion, including (but not limited to) the Prize, any contract for sale and purchase of real estate entered into by the Winner and any property purchased by the Winner.
  6. This Promotion is solely the Promotion of realestate.co.nz and is not sponsored or endorsed by any third party.
  7. Realestate.co.nz owns and operates www.realestate.co.nz, a real estate property listing portal. It is not involved in the contract of sale and purchase of real estate.
  8. If any terms are found to be unenforceable, illegal or invalid, the clause is deemed modified to the extent required to remedy the illegality, unenforceability or invalidity. If modification is not possible, the clause will be treated as severed from these terms without affecting any other clause.
  9. These terms and conditions are governed by the laws of New Zealand and you submit to the non-exclusive jurisdiction of the New Zealand Courts.
