Realestate.co.nz Limited, 155 Khyber Pass Road, Grafton, Auckland (“Promoter”, “realestate.co.nz”, “us” and “we”)

Promotion: Track a property – save an unlisted property

Entry into the Promotion is deemed acceptance of these terms and conditions:

Eligibility

1. To be eligible to enter, you must be:

1. an individual who is 18 years or over; and
2. a New Zealand resident

2. You are not eligible to enter if you are:

1. an employee, contractor or director of realestate.co.nz (Personnel).
2. a member of a Personnel’s immediate family.
3. an employee, contractor or director of any third-party service provider who is directly involved in this Promotion.
4. a licenced real estate agent, or a licenced salesperson (licenced under the Real Estate Agents Act 2008).

3. It is the responsibility of each person entering the Promotion (Entrant) to ensure they meet the eligibility criteria.

How to enter

1. During the Promotion Period you must do the following:
   1. Sign up to realestate.co.nz (if you already have an account, then you do not need to do this again).
   2. Log in to realestate.co.nz.
   3. Save an unlisted property.
   4. Complete the entry form and agree to the Terms and Conditions.
2. At midnight on Sunday 27th April 2025, you must have an active realestate.co.nz account and have saved a unlisted property at any time during the Promotion Period.

6. Only 1 entry per person. To avoid doubt, a person must not use different email addresses to enter more than once.

7. There is no fee for entering the Promotion.

Prize and prize draw and notification

8. There is one prize to be won of $5,000 (Prize). Details of the Prize is set out at the end of these terms and conditions.

9. The winner will be determined by a random draw, which will take place on Monday 28th April 2025. The winner will be the first valid entry randomly drawn from all eligible entries (Winner). To be eligible to claim the Prize, the Winner must be able to satisfy the Winner Prize Criteria set out in clause 13 below.

10. The Winner will be notified within 72 hours of the prize draw taking place.

11. If the Winner does not make contact with realestate.co.nz by email (info@realestate.co.nz) or phone 0800 732 536within 72 hours after realestate.co.nz has made reasonable attempts to make contact, the Winner forfeits the Prize and a new Winner will be determined on the same basis as the first Prize draw. This will continue until such time as a Winner is found.

12. The Prize cannot be changed, transferred or assigned. In the event that the Prize or any part of the Prize becomes unavailable for any reason, the Promoter may in its sole discretion, provide an alternative Prize.

Further terms if you are the Winner

1. They will make themselves reasonably available for promotional/advertising purposes and being photographed for this purpose without any claim for compensation.
2. Their name, town/city where they live, photos and likeness will be used by us for promotional and advertising purposes. This may include being published on our website, in newsletters, client communications, social sites, and other media platforms (such as television).
3. To grant realestate.co.nz a perpetual, world-wide, royalty free and non-exclusive right and licence to reproduce, edit, publish distribute and otherwise use their entry details and photos for advertising, publicity, promotion and marketing purposes. The Winner will not be entitled to any fee for such use.

Privacy - what we do with your personal information

14. When you enter this Promotion, realestate.co.nz collects personal information from you:
name, email address, contact number, property journey information (‘where are you in your property journey?) (“Profile information”)

15. The Profile information is collected for the purposes of this Promotion and for populating your account profile and may be linked to other personal information we hold on you that relates to your realestate.co.nz account. You can update or amend your name, email address or property journey information at any time by logging into your account. You can also delete all this information by deleting your account. Your phone number will only be used to contact you if you are the Winner and then deleted 14 days after the promotion closes and the Winner has been successfully contacted.

Other terms and conditions

1. Acknowledges they have read our Privacy Policy.
2. Consents to our website terms and conditions.
3. Consents to realestate.co.nz sending emails to the email address provided on registration with realestate.co.nz.

18. We may verify the eligibility of entries and Entrants (including identity, age, residency status or other information). We reserve the right to disqualify any entry or refuse to award the Prize where false or misleading details have been given or where we believe (acting reasonably) an Entrant has been fraudulent or dishonest or is in breach of these terms and conditions.

19. Failure by realestate.co.nz to enforce any rights will not constitute a waiver for those rights.

20. realestate.co. will not be responsible for any late, incomplete, lost or misdirected entries, including entries not received due to technical problems.

21. Except for any liability that cannot be excluded by law, realestate.co.nz, its Personnel, and any agencies involved in this Promotion will not be liable for any loss, damage, liability, penalty, personal injury, fine, charge, expense, outgoing, tax, payment or costs of any kind (including legal and other professional costs) arising from the Promotion, including (but not limited to) anything contained in the Prize, any contract for the rental of residential property entered into by the Winner and any property rented by the Winner.

22. This Promotion is solely the Promotion of realestate.co.nz and is not endorsed by any third party.

23. realestate.co.nz owns and operates www.realestate.co.nz, a real estate property listing portal. It is not involved in the contract for residential tenancies or the sale and purchase of real estate.
